TERMS & CONDITIONS

These Terms of Use, including any policies, rules and other terms expressly incorporated herein by reference (collectively, the “Terms”), form a legally binding agreement between you (“you” or “your”) and ONYX Pilates (“ONYX,” “we,” “us,” or “our”).
These Terms govern:
• Your access to and use of www.myonyxfit.com (the “Site”)
• Any ONYX mobile application (the “App”)
• Your participation in in-studio classes, sessions, or events
• Your purchase of memberships, passes, packs, single classes, retail products, or any other services offered by ONYX
Collectively, these are the “Services.”
By accessing the Site or App, booking or attending a class, or making any purchase, you agree to these Terms.
1. ACCEPTANCE OF TERMS
By accessing or using the Services, registering for an account, purchasing a Membership, attending a class, or clicking to accept these Terms, you agree to be legally bound.
If you do not agree, do not use the Services.
Additional agreements (including studio waivers and membership agreements) may apply (“Additional Terms”). If there is a conflict, the more specific agreement controls.
2. AGE REQUIREMENT
You must be at least the age of majority in your state of residence to use the Services. By using the Services, you represent that you meet this requirement.
3. MODIFICATIONS
We may modify these Terms at any time. Updates will be posted on the Site. Continued use of the Services constitutes acceptance of the updated Terms.
4. PRIVACY
Your personal information is governed by our Privacy Policy, incorporated herein by reference.
5. MOBILE SERVICES
If you access the Services via mobile device, carrier charges may apply. By providing your phone number, you consent to receive marketing and service-related communications. Consent is not a condition of purchase.
6. ACCOUNTS
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
We may suspend or terminate accounts for violations of these Terms.
7. MEMBERSHIPS; BILLING; SUSPENSIONS; CANCELLATIONS; RENEWALS
This Section governs all recurring memberships (“Memberships”).
7.1 Billing Authorization
By purchasing a Membership, you authorize ONYX to charge your payment method for:
• Recurring monthly dues
• Applicable taxes
• Late cancel or no-show fees
• Retail purchases
• Early termination penalties
Memberships automatically renew at the then-current publicly listed rate unless canceled in accordance with these Terms.
If a payment fails, you remain responsible for all outstanding balances. Access may be suspended until resolved.
ONYX may change pricing or features with notice where required.
7.2 Membership Suspensions (Freezes)
Complimentary Annual Freeze
Members are eligible for one (1) fourteen (14) day complimentary Membership freeze once annually.
Extended Medical Freeze
ONYX may, at its sole discretion, grant extended freezes for medical reasons. Supporting documentation may be required.
Membership dues resume automatically at the conclusion of the freeze period.
Freeze time does not shorten commitment terms.
7.3 Cancellation Requirements
All Membership cancellations require:
• Written notice
• At least thirty (30) days prior to the requested cancellation date
Written notice must be delivered:
• By email
• In person at the studio
• By certified or registered mail
Verbal requests or non-attendance do not constitute cancellation.
All final payments will be processed at the time cancellation notice is submitted.
Membership fees are non-refundable and non-prorated except where required by law.
7.4 Month-to-Month Memberships
• Automatically renew at the current publicly listed rate
• May be canceled after the first billing period
• Require 30 days written notice
• No cancellation fee after first billing period
• Final payment processed upon cancellation submission
7.5 Commit Six Membership
Commitment Term
Minimum six (6) month commitment.
Member’s monthly rate is locked for the full commitment period.
Early Termination
If canceled before the start of the fifth (5th) month:
• Early termination penalty = one (1) month’s dues
End of Commitment
After six months, member may:
• Renew at current commitment rate, or
• Convert to month-to-month at prevailing rate
All final payments and penalties are processed upon cancellation request.
7.6 Commit Twelve Membership
Commitment Term
Minimum twelve (12) month commitment.
Rate locked during full commitment period.
Early Termination Penalties
• Cancel before start of 6th month:
• Penalty = two (2) months’ dues
• Cancel between 7th month and start of 11th month:
• Penalty = one (1) month’s dues
End of Commitment
Member may:
• Renew at then-current commitment rate, or
• Convert to month-to-month at prevailing rate
All final payments and penalties are charged upon cancellation submission.
8. PASSES, PACKS, AND SINGLE CLASSES
Passes
Recurring passes renew automatically unless canceled under Membership cancellation rules.
Class Packs
• One-time purchase
• Non-refundable
• Non-transferable
• Expire as stated at purchase
• Subject to late cancel and no-show forfeiture
Single Class
• Non-refundable
• Converts to class credit if canceled at least 8 hours before start
• Forfeited if late canceled or no-show
• Expires 30 days after purchase
9. PURCHASES & RETAIL
All sales are subject to availability.
Returns accepted within 30 days if unused and in original packaging, unless otherwise stated.
Shipping dates are estimates.
10. STUDIO POLICIES
Late cancel and no-show fees apply as disclosed in studio policies.
ONYX reserves the right to refuse service for misconduct or safety concerns.
11. DISCLAIMER OF WARRANTIES
The Services, including workouts and health-related content, are provided for general informational purposes only and do not constitute medical advice.
Consult a physician before beginning any exercise program.
All Services are provided “AS IS” without warranties of any kind.
12. LIMITATION OF LIABILITY
To the fullest extent permitted by law, ONYX shall not be liable for indirect, incidental, or consequential damages.
Total liability shall not exceed $100.
13. INDEMNIFICATION
You agree to indemnify ONYX against claims arising from your use of the Services or violation of these Terms.
14. GOVERNING LAW
These Terms are governed by the laws of the State of Illinois
15. DISPUTE RESOLUTION & ARBITRATION
All disputes shall be resolved by binding individual arbitration in Cook County, Illinois.
You waive the right to a jury trial and to participate in class actions.
Claims must be brought within one (1) year.
16. MISCELLANEOUS
If any provision is deemed unenforceable, the remainder remains in effect.
These Terms constitute the entire agreement between you and ONYX.
